Regarding the change in the voting process for the candidate for Speaker of the Assembly of Kosovo during today’s constitutive session, elected LDK MP Doarsa Kica-Xhelili has reacted.
She states that there is no legal right to change the voting method from open to secret in the middle of the process.
The MP adds that such a move is not allowed by parliamentary practice.
“NO – they have no right to change the voting method from open to secret MIDWAY through the process. Parliamentary practice does not legitimize this. The Constitution’s reference to the Assembly Rules of Procedure is imperative—it grants the Rules normative power. They are not merely internal guidelines, but a constitutional procedural norm for electing the Speaker. The Constitutional Court itself confirmed this in the very case the ruling power is now invoking.”
“Specifically, paragraph 106 of that ruling clarifies that while the Constitution provides the structural foundation, the Rules of Procedure serve as the procedural mechanism to implement constitutional provisions—including determining the form of voting. And the Rules of Procedure of the Assembly of Kosovo—let alone parliamentary practice—do not allow for arbitrary changes to the voting method after the process has begun. And when you think about it—you’re invoking the Constitutional Court’s practice? You’re acting hypocritically, obstructively, propagandistically, and with utter irresponsibility,” Kica-Xhelili wrote on Facebook.
