PDK Submits Request to Constitutional Court Over Violations in Assembly’s Constitutive Session

The Democratic Party of Kosovo (PDK) has officially submitted a request to the Constitutional Court to assess the constitutionality of actions taken during the constitutive session of the Assembly of Kosovo held on June 29 and continued on July 1 and 3, 2025.

The request, filed on behalf of the PDK Parliamentary Group, challenges several actions taken during those sessions, namely:

The call for proposals for members of the Commission for Secret Voting

The vote held on the establishment of this Commission

The actual voting for the Commission

The arbitrary interruption of the session after the Commission was not approved

“These actions were taken in open violation of the Constitution of the Republic of Kosovo and the recent ruling by the Constitutional Court, which established a new legal reality and clearly outlined the constitutional procedures for the Assembly’s formation,” the party stated in a press release.

PDK Requests the Court to:
Declare unconstitutional the vote to establish the Commission for Secret Voting

Declare unconstitutional the decision to interrupt the constitutive session

Instruct the Assembly to resume and conclude the session, including the election of the Speaker, through an open and transparent vote, as mandated by the Constitution and parliamentary tradition

PDK emphasized that this legal move is essential to prevent the subversion of democratic order, ensuring that no temporary parliamentary majority places itself above the Constitution.
