Daka: Whoever Has 61 Votes Has the Right to Form the Government

Former Chair of the Central Election Commission (CEC), Valdete Daka, has provided clarifications regarding the formation of Kosovo’s new government and the constitutional right to obtain the mandate in the Assembly.

According to her, any political party that secures 61 votes in the Assembly has the right to propose a prime minister-designate and form the government.
“Whoever has 61 votes regardless of the party and convinces the President that they have that majority, can present the name of the nominee and obtain the mandate to form the government,” Daka emphasized.

She added that after November 5, if there is a candidate claiming to have 61 votes, the Assembly must convene a session for the vote.
“Immediately after November 5, the Assembly session must be scheduled if someone claims to have 61 votes and is capable of forming a government, and in that session, the government should be voted on,” she stated.

Daka also commented on the possibility of Albin Kurti attempting again to form a government:
“Not with the same name — he could propose another nominee — but he must present credible evidence that he has 61 votes and identify the individuals who will secure those votes on the day of the vote.”

President Vjosa Osmani has a constitutional deadline until November 5 to decide whether to call new elections or to mandate someone to form the new executive.
