Court on BKS Scandal Arrests: Actions Were Carried Out in Accordance with the Law

The Basic Court in Prizren has responded to claims by defense lawyers alleging that 35 detainees in the BKS scandal case are being held unlawfully.

In an official statement, the court rejected the lawyers’ allegations, emphasizing that the actions taken by the judiciary were fully compliant with the law.

According to the court, the pre-trial judge acted in accordance with legal procedures, noting that at the conclusion of the hearing at 22:10, it was officially recorded that the suspects would be returned to their detention centers while awaiting the court’s decision on the prosecution’s request.

The court cited Article 162, paragraph 8 of the Criminal Procedure Code, which stipulates that:

  • A detention hearing must be held as soon as possible, but no later than 48 hours after arrest.
  • Pending the court’s decision, the suspect may legally remain in detention.

The statement clarifies that the hearing was held within the legally required 48-hour timeframe, and that the continued detention of the suspects during the decision-making period was lawful and justified under the Criminal Procedure Code.
