Defense Proposal to Hear Nine Witnesses Rejected in the “Banjska” Case

The Basic Court in Prishtina has rejected the defense’s proposal to hear nine witnesses suggested by attorney Jovana Filipović, noting that even the claims of the Special Prosecution of the Republic of Kosovo (SPRK) do not indicate that the defendant had a direct role during the critical dates described in the defense submission.

The court emphasized that the proposed witnesses would not alter the assessment of the defendant’s guilt or innocence, as the indictment charges him only with an assisting role within the accused group.

Additionally, the court rejected the defense’s request for expert analysis comparing uniforms, stating that such an evaluation can be made directly from the photographic evidence. Regarding the question of whether the weapon in question was a sniper rifle or a hunting rifle, the court said this is not relevant to determining Dušan Maksimović’s involvement in the terrorist group.

Presiding judge Ngadhënjim Arrni stated that a detailed reasoning regarding the legal basis and justification for rejecting these proposals will be included in the written judgment.

However, Filipović’s proposal to hear witness Millosh Radosajlleviq remains approved and will proceed as previously authorized by the court.

Today marks the continuation of the trial in the “Banjska” case at the Basic Court in Prishtina following a change in the judicial panel.

The case, previously presided over by judge Arben Hoti, is now led by judge Ngadhënjim Arrni as panel chair, with members Rrahman Beqiri and Donikë Shala, after Hoti was promoted to the Court of Appeals.
