The Democratic Party of Kosovo (PDK) has expressed concern over the recent developments related to the actions of the Specialized Chambers in The Hague.
In its statement, PDK emphasized that “The Specialized Chambers were created to ensure justice based on European standards, not to create public spectacles in its name.” The party stressed the importance of maintaining the highest standards of justice and impartiality, which are the cornerstone of any judicial institution, including the Specialized Chambers.
“Justice and impartiality are not only demands but essential conditions for a fair and credible process,” the statement continued. PDK believes that any deviation from this mandate, through actions that could undermine citizens’ trust and the integrity of justice, is wrong. The party insists that all proceedings conducted by the Specialized Chambers should be based on full transparency and should not exceed their mandate.
The Special Court recently arrested Isni Kilaj, Bashkim Smakaj, and Fadil Fazliu, while the home of Hajredin Kuçi was raided.
“The Kosovo Assembly established the Specialized Chambers with a specific and limited mandate to address the monstrous accusations from the Dick Marty report. As PDK, we express our concern regarding the long delays and lack of transparency in the judicial processes against former leaders of the Kosovo Liberation Army (KLA) and senior state officials. PDK supported the establishment of this court, trusting the guarantees given by our allies that it would operate on clear principles of transparency and democracy,” said the statement.
The party reiterated that every citizen of Kosovo and every accused individual has the right to be treated impartially, without prejudice, and with full justice. However, the recent submissions from the defense of the four accused have raised serious concerns regarding unfair treatment, with concerns about violations of the principle of equality and the presumption of innocence. PDK calls on the Specialized Chambers to fulfill their duty with professionalism and impartiality, respecting the fundamental principles of justice, human rights, and the rule of law.
