The Constitutional Court has ruled that the Assembly of Kosovo remains unconstituted.
It published the dispositive part of its judgment today, stating that it found: “The Constitutive Session of the Assembly, which began on April 15, 2025, has not been concluded as a result of the failure to elect the Deputy Speaker of the Assembly from among the Serb deputies.”
The Court requires the election of all five Deputy Speakers, including the one from the Serb community. It refers to paragraphs 1 and 4 of the constitutional article that provides for the election of two Deputy Speakers from non-majority communities.
The Court ordered that the constitutive session be completed within 12 days from the date this judgment enters into force.
Deputies have been instructed to exercise their function in the “best interest of the Republic of Kosovo” and to elect the Serb Deputy Speaker.
“TO ORDER all elected deputies of the Assembly of the Republic of Kosovo, in accordance with Article 4 [Form of Government and Separation of Power], Article 7 [Values], paragraph 4 of Article 67 [Election of the President and Deputy Speakers], and Article 74 [Exercise of the Function] of the Constitution of the Republic of Kosovo, that during the procedure of electing the Deputy Speaker of the Assembly of the Republic of Kosovo from among the Serb deputies, they exercise their constitutional function in the best interest of the Republic of Kosovo and in accordance with the Constitution and the Rules of Procedure of the Assembly,” the ruling states.
