The Kosovo Judicial Council (KJC/KGJK) has announced that it will review Acting President Albulena Haxhiu’s request concerning the long-pending resignations of Serbian judges during its meeting on Friday, July 24, 2026.
The issue appears as the ninth agenda item at the Council’s upcoming session and concerns Haxhiu’s request, along with notifications submitted by Serbian judges and judicial staff seeking to withdraw the resignations they tendered in 2022.
In a letter sent on June 19, 2026, to KJC Chair Rrustem Thaqi, Haxhiu urged the Council to bring the matter to a conclusion, arguing that leaving the positions vacant for years undermines legal certainty and weakens the functioning of Kosovo’s justice system.
“Keeping these positions vacant for such a long period undermines legal certainty, hampers the full functioning of the justice system, and affects the efficiency of the responsible institutions,” Haxhiu wrote.
The development comes just days after the Kosovo Prosecutorial Council (KPC) rejected the withdrawal of resignations submitted by Serbian prosecutors and support staff, forwarding the case to Haxhiu, who subsequently signed decrees dismissing seven Serbian prosecutors who had resigned in 2022.
The decisions by both the KPC and Acting President Haxhiu have drawn criticism from the European Union.
In a statement, the EU said it was concerned that accepting resignations that had already been withdrawn and subsequently formalizing those dismissals appears inconsistent with Kosovo’s legal framework, due process, and the rule of law.
The EU also urged Kosovo’s institutions to refrain from actions that could hinder the reintegration of Kosovo Serb judicial personnel into the justice system.
