The Supreme Court of the Republic of Kosovo has rejected the appeal filed by Sami Kurteshi and Alban Krasniqi against the Election Complaints and Appeals Panel (ECAP) decision certifying the candidates of the Serbian List for the upcoming local elections.
“The appeal filed by Sami Kurteshi and Alban Krasniqi, both residing in Prishtina and members of the Central Election Commission (CEC), against the ECAP decision A.nr.3/2025, dated 23.08.2025, is dismissed as inadmissible,” the ruling states.
The Court determined that there is no legal basis that allows a CEC member, in their personal capacity, to challenge in the Supreme Court a decision made by the institution in which they serve.
“Therefore, since there is no legal basis that permits or grants the right to an individual member of the CEC to act as a party in judicial proceedings in cases where CEC decisions are contested, the Supreme Court concluded that the appeal submitted by the appellants is inadmissible. As a result, the panel of this court did not engage in a substantive review of the matter raised by the appellants,” the decision further states.
