The filing of the indictment for the September 24 attack in Banjska cannot be done until most of the evidence is abroad for expertise.
Dukagjini learns that some of the evidence that was sent are the weapons that were found at the scene, and that were sent to several different countries. And instead of criticizing the Special Prosecutor’s Office, civil society calls on the government to fulfill its obligations and operationalize the laboratories that enable examinations for such cases.

One of the reasons that the Special Prosecutor’s Office of Kosovo has not yet completed the indictment is the sending abroad of a significant number of evidence for expertise that is not carried out in our country. For this, as the television has learned, among the evidence that included some of the weapons that were found at the scene, they were sent to countries such as the USA and Germany, but also to the region, to countries such as North Macedonia.
For the delays in filing the indictment, in particular after the former chairman of the Serbian List, Milan Radoicic, took responsibility for the attack, the Special Prosecutor’s Office has been constantly criticized by the executive. However, Ehat Miftaraj from the Kosovo Institute for Justice says that instead of criticizing the prosecution, investments should be made in laboratories that are not functional.
“For 4 years, this government unfortunately has not been able to make it functional, that is, the institutes dealing with Forensics, or even other institutes that would in some way facilitate the work of the prosecutors, just for information, the Banjska case, for example, which is let’s say that there is still no indictment, we can say that the prosecutors in this case are unable to make the indictment because a large number of evidences have been sent to different countries, whether in America, whether in Germany, Macedonia or other countries others to verify certain evidence and testimonies, for the reason that the institutions in Kosovo cannot do this due to the failure of the government”, stated Miftaraj.
The former colonel of the Kosovo Police, Rrahman Sylejmani, sees the complex to investigate this case, who says that, however, the same should be handled with high urgency by all institutions. This is because, according to Sylejmani, not filing the indictment could lead to a repetition of the attacks.
“What examinations have they asked for, if they have asked, if you ask for it urgently, it has been 8 months, come on, they have not been able to itch for a month for two for five, now that they are not transparent, they leave doubts that there is not a genuine work, and this is only spreading and contributing to the tension of the situation in the north there, and now we are facing such an attack that can be repeated again”, declared Sylejmani.
Regarding this topic, the Television has also requested an answer from the Ministry of Justice, but they have not returned an answer. Otherwise, the toxicology laboratory at the Institute of Forensic Medicine is out of order since December 2022.
