AVONET and 13 other civil society organizations have asked the Constitutional Court of Kosovo to take action regarding the implementation of Judgment KO124/25 in the ongoing process of constituting the Assembly elected in the June 7, 2026 parliamentary elections.
In a statement, AVONET said the request was submitted following recent developments in the Assembly’s constitution process.
According to the organizations, the final election results were certified on July 8, 2026, meaning the 30-day constitutional deadline for constituting the Assembly expired on August 7.
AVONET cited Constitutional Court Judgment KO124/25, arguing that the 30-day period constitutes a constitutional obligation within which all actions necessary for the full constitution of the Assembly must be completed.
“Under this interpretation, holding a session that does not conclude with the election of the Speaker and Deputy Speakers does not mean that the Assembly has been constituted,” the organization said.
According to AVONET, the constitutive session held on August 6 did not result in the full constitution of the Assembly, while its continuation was scheduled for August 8, after the expiration of the 30-day deadline.
The organizations have therefore asked the Constitutional Court to determine whether Judgment KO124/25 was implemented in accordance with its requirements and within the prescribed deadline.
The request was submitted under Rule 60 of the Constitutional Court’s Rules of Procedure, which provides a mechanism for cases involving alleged non-implementation of a court decision.
If the court determines that Judgment KO124/25 was not implemented, the organizations have asked it to take the measures provided for under its rules, including issuing a decision establishing non-implementation or non-enforcement and taking any other steps it considers necessary.
AVONET said the issue is of particular importance because it directly concerns the functioning of Kosovo’s elected institutions and respect for the constitutional order.
“The implementation of Constitutional Court decisions is an obligation for institutions and guarantees that political and institutional processes take place within the limits established by the Constitution and the legal order,” AVONET said.
The organizations said their request is intended to ensure legal and institutional clarity regarding the Assembly’s constitution process and compliance with Constitutional Court decisions, rather than to resolve the political dispute through political mechanisms.
