Biljana Đorđević, co-president of Serbia’s Green-Left Front (ZLF), has accused the country’s Constitutional Court of acting selectively and intervening only when it serves the interests of the ruling authorities.
In an interview with Nova, Đorđević said the Constitutional Court has remained largely inactive on numerous constitutional challenges submitted by the opposition, despite its primary responsibility to review the constitutionality and legality of state decisions.
“The Court is active only when it suits someone in the regime or the government, acting as a servant of the executive branch, which it should never be,” Đorđević said.
She noted that in January 2024, the opposition submitted three separate requests seeking the annulment of Serbia’s national, provincial, and Belgrade elections. According to her, the Court responded only to the challenge concerning the Belgrade elections.
“The Court stated there was no need to decide because, at the time we submitted the request, the Belgrade City Assembly had not yet been constituted and new elections were already being held. That was a deeply inadequate way of handling the case,” she said.
Đorđević added that the opposition has filed numerous other constitutional initiatives that have received no response, including a request submitted three years ago challenging the constitutionality of Serbia’s Social Card Law.
“We have submitted more than ten constitutional review initiatives together with our colleagues, and we have not received a single response,” she said, criticizing what she described as the Court’s prolonged inaction.
